Terms & Conditions of Sale
The following Terms and Conditions of sale will apply to all transactions with us and do not affect your statutory rights.
"You" is the Customer & "We", "Us" & "Our" is CleverGreen Ltd, its Employees, Directors and Agents.
1. You must inform us of any damage or shortages within 24hrs of receipt. Any damage to packaging must be noted on the delivery documentation for a claim to be valid.
2. If you order goods from us, we will consider this to be an offer and it is for us to accept this before a sale can be considered to have taken place.
3. Delivery Times are estimates only and we will only consider claims for lost items after a period of 21 days (unless stated). We will try to make sure you are contacted if we are not able to dispatch in time to achieve this timescale.
4. If you delay delivery, any ability to claim will end at the time we first attempted to complete the delivery via the courier, our liability is for damage caused by us or our agents or our negligence only up to this point.
5. The goods remain the property of CleverGreen Ltd until we have received payment in full.
6. We do not offer any credit facilities.
7. You must be 18 years of age or more to order via this web site.
8. If we are not able to supply the goods you have ordered we will supplement alternatives on a like for like basis or refund this part of the value of the sale only. In any event we will contact you first.
11. We will not be held liable for any other consequential loss in relation to the transaction.
12. No other refunds will be considered.
13. Our products are often very technical in their nature and although we may provide some technical information relating to the items we sell because of the technical nature of our range we cannot provide any assurances as to their accuracy. We provide technical information in good faith and believe that it is up to date. However, you should refer to the manufacturer if you require the latest information for the product required. Details of the manufacturer or distributor will be provided on request.
14. Photos & images used are for illustration only.
15. The price of the goods at the time of dispatch shall prevail.
16. INCO TERM 2000 EXW applies to all sales unless varied by the terms laid out above.
17. Any disputes will be settled under English Law or English Arbitration, the choice of which shall be ours. If Arbitration is chosen, the person(s) or organization chairing the case and ultimately deciding the outcome, will be our choice, but must be agreed by any third party/claimant.
We aim to do business with a policy of openness and try and keep things as simple as possible, if you are not clear what we mean in any of our terms or conditions, please contact us and we will try and make things as clear as we can and explain the reasons why we have a particular policy.
Please contact us for our latest T&C’s as they may have been updated. Our latest T&C’s will be applied based on the time and date point at which the order is placed. It is your responsibility to make sure you know what the terms of sale are before you decide to buy the item
You are protected by Distance Selling regulations. These regulations apply to UK "distance sales" (e.g. an internet or phone order that is sent through the post to the end user) and allows you to return goods (at your cost) within the period of 7 days of the sale date and get a full refund for the goods you purchased, provided they are in their original undamaged packaging and the item has not been used or assembled in any way. As soon as you use the goods, these regulations cease to apply unless the goods are defective (within their warranty terms), damaged in transit (notified within 24hrs) or not as described.
